It gives a statutory right for either party to a construction contract to refer a dispute to adjudication at any time. It is a faster and cheaper process than either arbitration or litigation and lends itself particularly to the speedy resolution of interim payment disputes in construction projects.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"560\" height=\"739\" src=\"http:\/\/patmcoscar.com\/wp-content\/uploads\/2021\/06\/Slideshow_0000s_0001_adj.png\" alt=\"\" class=\"wp-image-277\" srcset=\"https:\/\/patmcoscar.com\/wp-content\/uploads\/2021\/06\/Slideshow_0000s_0001_adj.png 560w, https:\/\/patmcoscar.com\/wp-content\/uploads\/2021\/06\/Slideshow_0000s_0001_adj-227x300.png 227w\" sizes=\"auto, (max-width: 560px) 100vw, 560px\" \/><\/figure>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n\n\n\n<p>The Construction Act also extends the right to refer a dispute to adjudication by including even those contracts which are partly in writing or verbal contracts.<\/p>\n\n\n\n<p>Adjudication can deal with all manner of disputes, including delays, disruption, additional cost claims, variations and valuations of work etc.<\/p>\n\n\n\n<p>The process commences when the referring party issues the referral notice.&nbsp; I can:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Prepare and issue the referral notice<\/li><li>Prepare and present the case for submission<\/li><li>Represent the client at any adjudication hearing<\/li><li>Prepare the appropriate response and defence to any referral notices received from other parties<\/li><\/ul>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The current law on Construction Contracts has revolutionised the settlement of disputes within the construction industry.
